Permanent Residency

Permanent residency applications require careful, complete and professional presentation of your documents and information. We have experience in this area and have knowledge of all the relevant criteria for each permanent residency category, in order to select and present you with the most suitable immigration solution.

1. Federal Skilled Worker (FSW)

The Federal Skilled Worker program is part of the Economic Class and this is managed by the Express Entry program. Federal Skilled workers are foreign nationals with experience in specific occupations and who are issued Canadian permanent resident visas based on their ability to become economically established in Canada. Immigrants are assessed based on their language skills, work experience, trade qualifications, and the existence of a qualifying job offer. We can assist in determining your eligibility; completing the online application; advising you on factors that could help improve your scores and assisting you with the full list of documents you need to gather for the Permanent Residency application if you are selected.

2. Canada Experience Class (CEC) 

The Canadian Experience Class is a Canadian immigration program created for Canada’s temporary foreign workers who wish to gain Permanent Resident status. Members of the CEC have typically established important networks in Canada as temporary foreign workers and international students. Candidates who are successful in meeting the selection criteria for this immigration program will become a permanent resident of Canada. International Students should consider the Canadian Experience Class. The Canadian Experience Class is designed to facilitate the transition from international student to permanent resident of Canada.  

After graduating from a qualifying academic program or course of study at a designated Canadian learning institution, many international graduates become eligible for a Post-Graduation Work Permit (PGWP).

3. Federal Skilled Trades

The Canadian Federal Skilled Trades program is a new Canadian immigration program for people who want to become Canadian permanent residents based on being in a qualified skilled trade. Applications are assessed based upon the applicant’s ability to become economically established in Canada.

4. Family Class Sponsorship Program

One of the many objectives of Canadian immigration law is to see that families are reunited in Canada. If you are a Canadian citizen or a permanent resident, you may be able to sponsor your spouse, conjugal or common-law partner, child (including an adopted child) or other eligible relative to become a permanent resident under one of the family classes. Permanent resident status will allow your family member to live, study and work in Canada.

5. Provincial Nominee Programs 

Only the federal government of Canada may issue permanent resident visas, however, provincial nominee programs authorize provinces and territories to nominate particular foreign nationals to apply for their Canadian permanent residency. Provinces and territories nominate applicants based on the labour market and economic needs of each province or territory.

6. Permanent Resident Card Renewal

Your PR card is official proof that you are a permanent resident of Canada. You should submit an application to renew your PR card if it will expire within 6 months. If your PR card has been lost or stolen, you must let IRCC know as soon as possible. If you are outside Canada, you must go to the nearest Canadian visa office. If you are inside Canada, you will need to tell IRCC about what happened by completing an online form available on the IRCC website. You can then apply to replace your PR card. Our firm assists clients with replacing an expired (or due to expire), destroyed, lost or stolen Permanent Resident card (PR card).

Temporary Residency

Temporary residency applications require careful, complete and professional presentation of your documents and information. We have the knowledge and experience related to the various criteria for temporary resident applications, and will advise you accordingly on your temporary resident application.

1. Study Permits

To apply for a Canada study permit, students must first enroll and be accepted to study at a Canadian educational institution. We help prospective students establish that they are eligible to study in Canada, by demonstrating that they:

      • have enough money to pay for their: tuition fees, living expenses, return transportation for themselves and any family members who accompany them.

      • are law-abiding citizen with no criminal record.

      • are in good health and willing to complete a medical examination, if necessary.

      • intend to leave Canada when they have completed your studies.

We also assist clients who want to extend their stay in Canada as students, by gathering documentation and submitting an Application to Change Conditions or Extend Your Stay in Canada.

2. Work Permits

We assist clients who require a work permit to legally work in Canada. There are two types of work permits issued in Canada: Closed Work Permits and Open Work Permits.

AdaJulie Legal PC can assist you by:

    • Assessing your options for a work permit;
    • Ensuring that your forms are properly filled and that you have all the required documents;
    • Writing submissions on your behalf to explain your specific situation to Immigration, Refugees and Citizenship Canada (IRCC) officials; and
    • Communicating with IRCC on your behalf.

To apply for a work permit in Canada, the following documents must be submitted to Immigration, Refugees and Citizenship Canada:

      • a job offer from a Canadian employer;
      • a completed application that shows that they meet the requirements of the Immigration and Refugee Protection Act and the Immigration and Refugee Protection Regulations; and,
      • a Labour Market Impact Assessment (LMIA) from Employment and Social Development Canada (ESDC) confirming that the employer can hire a foreign worker to fill the job.

Some clients may be exempt from the requirement to obtain a job offer and/or a LMIA, depending on their situation and the type of work they wish to pursue.

3. Visitor Visa

Foreign nationals require permission to enter Canada as a visitor and require either a Temporary Resident Visa (TRV) or an eTA (electronic Travel Authorization), unless they are US Citizens. Whether or not individuals will require a temporary resident visa is determined based on their citizenship. Foreign nationals who are exempt from a temporary resident visa requirement may still need to obtain an Electronic Travel Authorization (eTA) to travel to Canada. For more information on eTA, please see:

Foreign nationals requiring visas must also meet the following requirements:

    • Possess a valid travel document, such as a passport;
    • Satisfy an immigration officer that you have ties to your country of origin, such as a employment, home, financial assets and family, which will compel you to return;
    • Satisfy an immigration officer that you will leave Canada at the end of your visit;
    • Have sufficient funds for your stay;
    • Be in good health (a medical examination may be requested);
    • Have no criminal or immigration related offences;
    • You may also need a letter of invitation from someone who lives in Canada.

A foreign national may also need to meet other requirements for a visitor visa, such as biometrics, depending on their country of nationality.

We can also assist with extending your stay in Canada. You should apply 30 days before your status expires. If you apply to extend your visa, and it expires while you are waiting for a decision, you still have temporary resident (visitor) status, which is known as “implied status”.

4. Super Visa

A great way to bring Parents and Grandparents to Canada is through the Super Visa program. This program allows family members to come to Canada as long-term visitors on a multiple entry visa that may last up to 10 years.  A Super Visa is valid for 2 years before it has to be renewed.

​This is an ideal option for Canadian Citizens and Canadian Permanent Residents who are waiting to sponsor their parents for PR, or who currently do not qualify for Parental PR sponsorship.

We will assist in preparing your super visa application accurately and efficiently. Visa officers consider several things before they decide if you can come to Canada. You must be a real visitor to Canada who will leave by choice at the end of your visit. A visa officer will consider the following:

    • your ties to your home country;
    • the purpose of your visit;
    • your family and finances;
    • the overall economic and political stability of your home country; and
    • an invitation from a Canadian host.

To be eligible for a Super Visa you must also:

  • prove that your child or grandchild in Canada meets a minimum income threshold;
  • provide a written statement from that child or grandchild that he or she will give you financial support;
  • have valid Canadian medical insurance coverage for at least one year; and
  • have an immigration medical exam.

Citizenship Services

If your application for Canadian citizenship is refused, this decision may be appealed to the Federal Court of Canada. The first step in the appeal process involves filing a Notice of Application to the Federal Court within 30 days of receipt of the decision from Citizenship. This timeline is very important. We will examine the details of your case, determining whether the decision was unreasonable, or if there was a breach of procedural fairness. We will advance strong grounds of appeal before the Court, arguing that your case should be sent back for re-determination by a different Citizenship judge.
